The Royal Tulip City Center Tanger, an esteemed hotel located in Tangier, Morocco, offers a range of services (hereafter referred to as the “Services”) available for booking through its official website, its mobile applications, and on-site at the hotel.

These General Terms and Conditions of sale (hereinafter referred to as the “T&Cs”) apply to any booking made by a natural person who is not an individual commercial trader (hereinafter the “Guest”) using the Services provided exclusively by The Royal Tulip City Center Tanger.

The Guest should contact The Royal Tulip City Center Tanger directly to find out the terms and conditions of stay for the hotel (hereinafter referred to as the “T&Cs of Stay”).

By using the Services, the Guest acknowledges that they have full legal capacity allowing them to be bound under these T&Cs and guarantees the truthfulness and accuracy of the information provided.

ARTICLE 1: DEFINITIONS

“Mobile Applications”: refers to the mobile applications operated by The Royal Tulip City Center Tanger which the Guest can download and access from a mobile telephone or a tablet, and through which the Guest can make bookings at The Royal Tulip City Center Tanger.

“Guest(s)”: refers to the non-trading, adult, and legally competent individuals who make personal bookings for personal purposes at The Royal Tulip City Center Tanger.

“T&Cs of Stay”: refers to the document(s) issued by The Royal Tulip City Center Tanger describing the Terms and Conditions of stay at the hotel, including check-in and check-out times, child policies, etc. Guests should contact The Royal Tulip City Center Tanger to review its T&Cs of Stay.

“Data”: refers to all the information provided by the Guest when making a booking, about themselves and about third-party individuals for whom they are making the booking, including personal data.

“Personal Data”: refers to any information about a directly or indirectly identified or identifiable individual, in particular by reference to an identifier such as a name, identification number, location data, online username, or one or more particular indicators specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.

“Establishment”: refers to The Royal Tulip City Center Tanger hotel where Guests can make bookings for accommodation.

“Offer(s)”: refers to the accommodation options offered (beds, rooms, apartments, etc.) at The Royal Tulip City Center Tanger advertised through its Services, including the description of the hotel, the presentation and specific features of each accommodation type, the applicable rate, and the conditions of guarantee and cancellation. Different T&Cs of Stay may apply depending on the specifics of the booking.

“Partners”: refers to any third-party entities such as online travel agencies (e.g., Booking.com) through which The Royal Tulip City Center Tanger may be booked. The relationship with such Partners is governed by separate agreements that may influence the booking conditions available on their platforms.

“Booking(s)”; “Online Booking(s)”: refers to the reservation(s) of accommodation at The Royal Tulip City Center Tanger made via the Services.

“Personal Bookings”: refers to individual bookings that include a number of accommodations and/or persons as defined by The Royal Tulip City Center Tanger’s specific booking policies. This is distinct from “Group Bookings” which are subject to different terms and conditions and may involve different rates.

“Services”: refers to the online platforms such as the official website, mobile applications, and any associated booking sites through which The Royal Tulip City Center Tanger markets its accommodations and through which Guests can make Personal Bookings.

“Reserved Rate”: refers to the price and conditions applicable (cancellation, changes, etc.) as defined by these T&Cs and the Offer issued by The Royal Tulip City Center Tanger, selected and accepted by the Guest as part of their Booking and following confirmation of their Booking. This Rate may include any local and/or additional taxes corresponding to the additional services selected by the Guest.

ARTICLE 2: SCOPE: PERSONAL BOOKINGS

These Terms and Conditions (T&Cs) are applicable exclusively to Personal Bookings made through The Royal Tulip City Center Tanger’s booking platforms, including the official website, mobile applications, and any authorized online travel agencies.

The maximum number of accommodations that can be booked as part of a Personal Booking is determined by The Royal Tulip City Center Tanger’s booking policy. Guests wishing to make bookings for a larger number of accommodations or guests than permitted for Personal Bookings should contact The Royal Tulip City Center Tanger directly through the contact details provided on our official website or through the “Contact Us” feature on our mobile application.

ARTICLE 3: BOOKINGS – GENERAL RULES

3.1 Booking Process

Bookings made by the Guest are completed through The Royal Tulip City Center Tanger’s reservation system, which includes the official website, mobile application, and designated travel agents or third-party booking platforms, if any. A Booking is considered confirmed once a reservation number is generated and displayed on the confirmation screen, and the Guest receives an email confirmation. Each Booking is accompanied by a unique reservation number that allows the Guest to manage their Booking, subject to the terms and conditions of the Reserved Rate. The Guest must complete all mandatory fields on the booking form before submission.

3.2 Display of Prices

Prices quoted are valid at the time of inquiry or Booking on the platform. Prices are displayed inclusive of all taxes, and any change to the tax rate will be reflected in the prices at the time of billing. Prices are typically displayed in the currency of the country where The Royal Tulip City Center Tanger is located, but may be displayed in the currency selected by the Guest based on the location or language preferences. Currency conversions are estimated and non-binding. All Bookings are payable in the local currency of The Royal Tulip City Center Tanger unless otherwise specified.

3.3 Cancellation/Amendment by the Guest

The terms of the Reserved Rate define the conditions under which a Booking may be cancelled or amended. Non-refundable rates require full payment at the time of Booking and cannot be cancelled or changed. Flexible rates allow for cancellation or changes to be made up to a certain time before the check-in date without penalty. In case of early departure or no-show, the full amount of the stay as booked may be charged. Bookings are personal and non-transferrable.

3.4 Booking Times for Services

Online Booking availability may cease at a specified time before the check-in date. Guests should contact The Royal Tulip City Center Tanger directly for late bookings. ARTICLE 4: PAYMENT

4.1 General Payment Rules

The Royal Tulip City Center Tanger Hotel may provide links to third-party sites for the convenience of Guests. However, the hotel is not responsible for the content or the privacy practices of these external sites.

7.6 Availability and Reliability

While the Royal Tulip City Center Tanger Hotel makes every effort to ensure the availability and reliability of its booking platform and services, it cannot guarantee uninterrupted access or the absence of technical difficulties. The hotel will not be held liable for any inconvenience or loss arising from such issues, except in cases of negligence on the part of the hotel.

7.9 Guest Behavior

The Guest is expected to behave respectfully towards hotel staff and other guests at all times. The Royal Tulip City Center Tanger Hotel reserves the right to remove any Guest from the hotel premises who is found to be engaging in harmful or disruptive behavior, without any obligation to provide compensation or refund for any services not rendered as a result.

ARTICLE 8: CHANGES TO THE TERMS AND CONDITIONS

The terms and conditions that apply to the Guest's reservation and stay are those that were in effect at the time of the reservation and accepted by the Guest. However, the Royal Tulip City Center Tanger Hotel reserves the right to modify these terms and conditions at any time. 8.2 Guest Responsibility

11.4 Discrepancy

In the case of a discrepancy between the Booking confirmation and these Terms and Conditions, the details in the Booking confirmation will take precedence with respect to the commitment in question.

11.5 Headings

The headings contained in these Terms and Conditions are for reference purposes only and shall not affect in any way the meaning or interpretation of these Terms and Conditions.

ARTICLE 12: FORCE MAJEURE

12.1 Definition

Force Majeure refers to any external, unpredictable, insurmountable event that is beyond the control of both the Guest and The Royal Tulip City Center Tanger Hotel. Such instances of Force Majeure or fortuitous event are to be determined according to the jurisprudence of the courts where The Royal Tulip City Center Tanger Hotel is established.

12.2 Non-Liability

Neither party shall be held liable for a failure to perform its obligations if such failure is due to an event of Force Majeure. It is expressly understood between the parties that Force Majeure shall temporarily suspend the performance of their reciprocal obligations and that each party shall bear the costs incurred to them as a result.

ARTICLE 13: CLAIMS – GUEST SERVICES

13.1 Communication

For any inquiries or claims regarding a Booking, Guests should direct their communication either to The Royal Tulip City Center Tanger Hotel at which their stay was booked, to the Guest service of the third-party Partner involved in the Booking process, if applicable, or to The Royal Tulip City Center Tanger Hotel’s own guest service department, which will facilitate mediation between the involved parties as necessary.

ARTICLE 14: APPLICABLE LAW

14.1 Governing Law

The General Terms and Conditions set forth are governed by Moroccan law. In case of a dispute, the Guest may initiate proceedings in the jurisdiction of their residence at the time of the Booking or in the jurisdiction where the hotel is located. The Parties commit to seek an amicable resolution to any disputes that may arise. In the absence of an amicable settlement, the matter will be referred to the competent Moroccan courts, which will have exclusive jurisdiction.
